Fishing rights for wild trout in britain? (scotland specifically)?
Hey guys, i find more and more that when i go to fish for wild brown trout in remote areas that i have people coming and asking for permits etc. Obviously i would get a permit if i was fishing a larger river in sub urban areas esp if it was for salmon or sea trout but i find it ridiculous that people are expected to pay to fish in tiny, unstocked lochs/rivers in the middle of absolutely nowhere. I know that the 'right to roam' act allows me to cross private land to get to these places and the landowners apparently don't own the fish (unless they stock it), they only own the land so i'm not stealing. And if they don't own the fish then presumably any fishing rights would just apply to salmon etc. I have also been kicked off for fishing for wild pike which are a course species. Anyone know what my rights are here? are these landowners just "trying their luck" by asking us to buy a permit? thanks everyone

Apparently they aren't-according to this UK/Scotland government website while you may have the right to access a river you can't necessarily fish there. Ownership of Freshwater Fishing Rights Though, in general, it is not a criminal offence to fish for or take trout and other freshwater fish in Scotland, this does not imply that there is a free right to fish anywhere. The rights of riparian owners (who own the fishing rights) are protected by principles of civil law and permission should always be sought before fishing. No one, even if they are lawfully on the bank of a river or loch under a right of access, has an implied right to fish there. Fishing is only available to the owner of a fishery or with their written permission. Unlike in England and Wales, no national rod licence is required to fish in Scotland. Please see section 11 of the 2003 Act which states "Any person who without legal right, or without permission from a person having such right, fishes in a proper stank or loch shall be guilty of an offence, and liable on summary conviction to a fine not exceeding level 1 on the standard scale."
